Memo to: Under Sheriff Robert Hart

The following is the absolute happenings of 12-30-77 at 1730 hrs, the date and time of my arrival at the Garfield County Jail. On my way to the Booking Room I stopped and talked to Mr. Bundy, this took place about 1900 hrs, it was just passing the time of day, Mr. Bundy said he wasn’t feeling well and would turn in early. At 2400 hrs I made bed check and saw that Mr. Bundy was sleeping, also at 0130 and again at 0300.

On 12-31-77 at 0800 hrs Jail Cook Dolores Gomez served breakfast and she called Mr. Bundy but no answer; she told me that sometimes he didn’t eat because he hadn’t felt well. I looked in to check and saw him on the bunk (I assumed it was him) and I told Dolores to let him sleep. [According to Dolores: “the Jailer opened the door, stepped in, turned around, and said ‘oh hell, let him sleep, he was probably up walking all night.”]

Dolores served lunch about 1200, she then called me and said “there must be something wrong with him.” I then went into the cell, everything looked in place, he had the same shirt on that he had on the night before when we talked. I went to shake him but felt nothing but paper for an arm, wastebasket for shoulders, books for body and legs. I thought he was playing a joke on me (He had hidden under the bunk once as a joke).

I climbed up to the light fixture, it was loose and moved easily, the light bulb moved over to the side. I looked through the hole, found a blanket in the rafters and his transistor radio. I shot the beam of a flashlight all around the rafters with no luck.

[In her statement, Dolores elaborates: "I came back following the Jailer as he checked Bundy's cell and the other jail areas even asking the prisoner in the bull pen if there was anyone else back there with him. I then came back to the kitchen to do the dishes."]
