Ed Harvey's Affidavit, 1987

Ed Harvey was one of Bundy's court-appointed public defenders in 1979. Along with Bundy's other defense attorneys Mike Minerva and Millard Farmer, Harvey assisted in negotiating his client's aborted plea agreement. He was quickly convinced of both Bundy's mental instability and incompetency to stand trial, much less his ability to successfully act as his own counsel. In this affidavit from 1987, Harvey describes his difficult experience of working with Bundy and provides evidence from 1979 for his conclusions of incompetency. . .

"At one point defendant said that if "Son of Sam" and others are sane, he is sane. I tried to get him to approach the issue from the perspective of merely utilizing a legal defense that was available— in effect, conning everyone else like he conned Chapman, et al. (although I do not think he was conning them in Pensacola the first couple of nights, because of: (a) the acute psychotic break episode that defendant has described taking place in his cell, (b) his extreme memory loss and confusion re: events in Pensacola, and (c) his tone of voice, etc. on the tapes). He would not consider this tactic - he merely reiterated that insanity is something that is not present in this case… he would rather go to the electric chair able to maintain his innocence than make use of the insanity defense."

I'm not sure if standards were different back then or what but insanity would not be a viable defense for someone like Bundy in this day and age. The attempts to conceal the crimes alone would be enough demonstrate sanity enough for legal culpability. Let alone the planning and preparation that went into committing many of the murders.
