The dude was 100% killed to scare them, but it wouldn't have necessarily happened were he not seen at Gale's murder-scene. They made it VERY obvious that was serious when Mike asked him whether Jesse was seen, then asked whether /he/ was seen and the dude admitted he was.

Love your analysis, as always...but how the heck did you not mention the end of the episode with the police searching through Gale's apartment and it shows the 'Lab Notes'! haha anyways.
