It's not really just for torture but the fact that they have no idea how she kills since they know they need a name and face (or in Misa's case, they know she just needs a face, hence the blindfold) so they need to take extra pre caution cause in L's mind, she might be able to wish death on them simply by pointing at them.

The way I see L and Light being different is that L is indifferent to violating people's rights if it means furthering the investigation, but Light actually enjoys doing it (telling people he's Kira before killing them, watching them die etc)

The conversation over Misa's detention was interesting, but I can't say I disagree with L and the others' handling of the matter. Not to mention that the second Kira had just murdered their colleague a few days prior. I'm not surprised that L does not respect human rights. He stated unequivocally that he will go to whatever length to stop Kira the day he places the suspect residences under surveillance cameras.
At this moment, I'm completely behind L. Human rights, like every law devised by mankind, are flawed and will not assist you in your investigation of the world's most dangerous criminal, who has the capacity to murder virtually anybody he/she wants with demon magic.
So yeah, If I was L. I'll tie the shit out of her. Especially when they are the two ONLY suspects in the WHOLE WORLD.
