I think you guys might be slightly confused with the timeline. When the show introduces the SPK, they mention that Near had been investigating for 3 years, BUT, the entire time jump between L's death and the introduction of the SPK lasts 5 years (meaning that Near spent about 2 more years in the orphanage). The shows mentions that Light was 18 when L dies and now he is 23. When Near is first introduced, when L dies, he is 13, so now he is 18. He acts chidish but he is not actually a child, that's just a product of his personallity and the way he grew up.
