[Announcement] We're fighting the takedown
Added 2024-12-31 13:52:44 +0000 UTCThat's a bit of a loaded title and the situation is still unfolding so let me break it down for you all. When we were hit with the DMCA for the 40k collection we were granted a copy of the takedown request. It was pretty clear it was NOT from Games Workshop and was instead from some unknown and unrelated individual.
There were a few red flags including: coming from a gmail account that mimicked their official email signature, multiple spelling errors, grammar errors, mentioning me by name and not the company, incomplete information, incorrect information, and read like the ramblings of a warp-tainted cultist.
With that deduction I made the decision to send a counter notice. I haven't heard back from Patreon on the matter yet but will let you know how it settles out. This counter will put the ball back in the court of the person that filed it. The theory is that since it's not a genuine takedown request it will end there since they don't have the standing to sue on GW's behalf.
Right now I think it could go 2 ways: Patreon accepts the counter-notice, or Patreon does not accept the counter-notice (in time).
Patreon accepts the counter notice: things will continue as they normally would. November files will be archived for annual members at the end of the month, 40k files will be included in the MMF archives, and the older files will remain on the annual archive. I'll likely take down the in-progress projects so we can actually finish them properly though.
Patreon does NOT accept the counter-notice: I'm not sure why this would happen but in case it does, or in case we don't hear back from Patreon by 5PM EST today, we would continue as we have planned. 40k files will be scrubbed from the Google Drive and MMF archive and other points as mentioned in the previous post.
Sorry for the whiplash everyone, it's certainly been a tumultuous few days, but I want to keep you all in the loop as things are happening. In the meantime, we're working furiously to get all annual memberships added in time!

Most of the helmets shared the same dome and back piece, so they could be taken from the files already downloaded. Obviously, there would be no direct mention of specific 40k terms, but could be something like 'wolf helm customisation', 'secret angels customisation' and so on. This would stop any future DMCA's.

So I can only confirm that the email would have been an @gwlpc.com address and not Gmail. And the language in the email would have been professional, as grammar or spelling errors in legal documentation invalidate the validity of the document

What doesnt make sense is that our War Hammer shop here in Cork Ireland proudly and happily displays peoples builds. Asked the manager if we could display ours or would the comoamy come after us and he said no because the cosplay community is their number 1 customer and unless someone is selling figures they dont care. They even sell the big cans of paint, you need that for a tiny figure, so this definately wouldnt be them.

And it would be via a corporate email, it was years and years ago but I will try and find the email so you can see an example of how they communicate.
