I think I can explain why it is that emulators themselves aren't illegal while distributing the BIOS and ROMs are. It stems from the fact that intellectual property around code is pretty specific. Since copyrighting the idea of a piece of code would MASSIVELY limit the products that can be created (because someone could claim copyright of the idea of a pathfinding algorithm), copyright on code is specifically about the exact implementation. This is why distributing the BIOS is illegal, because you are distributing the code that was written by Sony. But when we're talking about an emulator, we aren't talking about something made by Sony. An emulator isn't just a copy of the software running on the Playstation - because different CPUs have different "languages" they understand so modern CPUs cannot understand the code that a Playstation CPU understands. What emulators do is that they "simulate" the physical hardware of the Playstation. So essentially you have a virtual Playstation running on your computer when you emulate (this is also why emulators perform worse than original hardware - because you have to both run the game AND simulate the hardware of the console). So an emulator contains no code that was written by Sony, and therefore it isn't covered by their copyright. I hope that makes sense! I know it isn't related to this Bonus episode, I just thought this was the place you would be more likely to see it :P Anyway, I really enjoyed the episode!
