the wording of the new law, is more enabling Defamation to be be considered a high enough crime (it is still minor now) to enable the police to get a warrant to get information from ISP, ISP already know who everyone is, but as a service provider, they are only obliged to tell if a warrant is issued, and warrants only concern high crimes (because protection of privacy, a human right, Korea signed), the bill would allow the police to go to a judge, and get the warrant to force ISP to identify... it would be groundbreaking, it would "pave a way" (a real one), because western countries could follow, if its worded correctly..... remember only if you are ,to a proven degree, engaging in defamation, a warrant could be issued... You cant prosecute a person you cant identify, remember that when labels say they will sue, its just hot air, unless they by legal means can identify you, there is no case... thats the problem, thats what the Sulli bill is trying to address

The threat of being sued doesn't stop these people, and we know these service providers don't have good security at all. The better alternative is these websites should have to hire content moderators. Anyone going through China should only bring burner phones, it is well know they install spyware when you go through security.

Hi Danny, I agree with your comments on the real name commenting system. I support some kind of ban/regulation on hate speech but I recognize the difficulty in balancing that with freedom of speech (a right we technically don't have in Australia, but have in practice). I think it's a tough question politicians should tackle.

Hi Danny - I hope South Korea will give the North Korean soccer players VVIP treatment. It’s not the players fault how the NK govt treated the SK players. Add that to someone saying to them directly, “This is how we treat all foreign players” —> and it’s not a far leap in the NK mind to fan the flame of truth. As for revenge - a stadium full of fans and a win would do that! Ha! Re: Windows Explorer.... If I had to do what you just described to get on a govt site, I would DEFINITELY give up. I’ve seen several expatriates in SK discuss/complain about this online. I remember something about the online mail system tracking only allows a certain number of characters and doesn’t allow for spacing between names (김유미 vs. Sam Smith) - so getting packages is a huge hassle Still true? Maybe you could do a post about that! Anyway, with all of SK’s internet speed and sophistication, it’s frankly hard to believe the govt is stuck in Windows Explorer. What would it take to modernize? Blue House petition? Are they in some kind of contract they can’t get out of? Why don’t they update?

Good podcast. As for the real name system, whenever you ban something, people will find another way to do it, illegal or otherwise. I imagine many more people would start to use VPNs and websites not hosted in Korea, which isn't in the government's best interest.

All said and done I feel pity for North Korea. Its position is like that of a struggling child, who lashes out at others and does weird things, just because it does not want to show its weaknesses. Its leadership has a difficult task to play in getting approval of international community, while continuing to keep facade of being untouchable. In this scenario, if the aim of the Korean public remains of having one Korea, then South Korea would have to continue to turn blind eye to their tantrums. Someone has to be mature in this scenario.
