Another YouTube strike.
Added 2018-11-29 06:39:23 +0000 UTCReally silly reason this time. A long time ago I showed an industrial roller limit switch bought from eBay and took it to bits.
It appears it was a copy of a Dutch brand and they asked me to take the video down because it had their logo on the switch.
I agreed and made the video private so it couldn't be viewed, but the process has still continued and a strike has been applied.
Good time of year to get a channel strike.

You joke, but without some form of protection many content creators won't be a thing at all. As ubiquitous as YouTube might seem it still runs on the same principle as any other business: Money. If the creators aren't making any then they'll do something that does. It's the very reason Clive uses Patreon to begin with.

2018-11-30 08:33:53 +0000 UTCThe EU will soon regulate itself into having a segregated internet that is about as useful and functional as a 1999 mobile phone WAP browser. Enjoy.
Jeff Groves
2018-11-30 07:35:53 +0000 UTCWith new EU laws, and laws elsewhere, this problem will grow. They will have to enact new laws to deal with those that abuse the others. Yay. In the mean time we are stuck in the middle.

2018-11-30 06:33:24 +0000 UTCCody tried Vimeo and that didn't work. :(

2018-11-30 06:18:10 +0000 UTCThanks for the clarification. That might explain why I didn't see it in archive.org
Jim
2018-11-30 01:51:06 +0000 UTCI believe the link you're referring to is actually hosted on EndlessVideo, which is asking for authentication when you click on it due to the video not being on YouTube anymore. The date 9 Oct 2018 is when Google first saw the EndlessVideo link, not when the video was actually uploaded to YouTube. I have the original video downloaded (I archive channels that I like) and it was uploaded on 2017-03-29

2018-11-29 20:26:04 +0000 UTCThere must be a decent alternative to YouTube. Google are certainly getting nothing off me for premium YouTube / Music services when they act like this.
John Russell
2018-11-29 19:38:20 +0000 UTCthis is stupid.... Youtube needs an overhaul
Richard Boyce
2018-11-29 19:27:11 +0000 UTCAre the Dutch being fussy because of Brexit ?
2018-11-29 17:50:51 +0000 UTCIs it 3 strikes and your channel is banned/shut down ?
2018-11-29 17:50:34 +0000 UTCI just searched Google for (bigclive roller limit switch) and found an entry for Oct 9 2018. Is this the offending post? If I shouldn't have posted this please just delete.
Jim
2018-11-29 17:23:56 +0000 UTCGood Lord, YouTube is stupid.
2018-11-29 16:13:29 +0000 UTCVery disappointing, I believe in the video you even went out of your way to specify your opinion of it being fake, so it isn't like the audience were misled in any way. Really big shame there still isn't a good alternative to youtube!
Adam 'RDL' Taylor
2018-11-29 15:38:39 +0000 UTCI'd totally argue that case to YouTube. I'd have to agree with that fair usage argument, or at least educational usage.
Adam 'RDL' Taylor
2018-11-29 15:37:25 +0000 UTCIt would make Skynet more exciting if it just shot people on a whim.
Big Clive
2018-11-29 14:59:54 +0000 UTCIt's the second time, but I managed to get the first one lifted. Otherwise I would no longer be able to upload video content.
Big Clive
2018-11-29 14:58:51 +0000 UTCThe first stage is not reviewed by a human. I've requested human intervention.

2018-11-29 14:57:36 +0000 UTCThe way the company was reacting it would still have gone ahead.
Big Clive
2018-11-29 14:56:46 +0000 UTCI've worked with the BBC in the past, so I know exactly what their contracts are like. They often include text to cover other planets and civilisations discovered in the future. The BBC is the propaganda channel of a certain section of the UK government.
Big Clive
2018-11-29 14:56:08 +0000 UTCPost the name of the company that called foul and we will all send our comments to them until they get the idea. Youtubes guidlines: 1. The purpose and character of the use, including whether such use is of commercial nature or is for non-profit educational purposes
2018-11-29 14:35:52 +0000 UTCWith the proposed EU legislation where YouTube will be liable for content creator’s copyright infringements this will get worse.
Rav
2018-11-29 14:09:42 +0000 UTCY'see you made a mistake - you took the correct action instead of just covering the logo up with the Belgian National flag *coughs*
2018-11-29 13:56:56 +0000 UTCPlease mention the name of said company, so we can avoid accidentally purchasing anything from them until they get half-way educated lawyers.
Al Hunt
2018-11-29 13:47:25 +0000 UTCThe evil side of me sees videos banned from YouTube being shared ... elsewhere. ;)
2018-11-29 13:36:06 +0000 UTCHow is that worthy of a strike? That falls under fair-use afaik
David K
2018-11-29 13:32:05 +0000 UTCThat has to be unbelievably annoying. From what I've seen from others on YouTube it's a buggy automated system with little oversight. They don't even seem to want to acknowledge there is a problem.
Dylan Z. Neill
2018-11-29 13:17:42 +0000 UTCYouTube are a bunch of cunts.
2018-11-29 12:57:06 +0000 UTCTimes I dont understand the use of the strike system. Its not a DMCA thing (even if it HAS a logo), and pretty sure you've been clear on just about everything its an ebay/china/etc purchase for fun etc, so I can't see how its intentionally defamatory or anything of the sort. And to voluntarily take down when asked... and still get one.... seriously.... what is up with companies... sheesh
William Huckaba
2018-11-29 12:38:37 +0000 UTCYes they are because YouTube is owned and run by Google who buy up every company to control everything and collect data on everyone so they can use it for marketing everywhere.
Gadgetman
2018-11-29 12:16:16 +0000 UTCIt's sad that the marketing/"intellectual property" operatives of corporations don't get a second opinion from e.g. one of the company's ENGINEERS before coming out with all guns blazing. A clever Engineer might have come up with the idea of sending Clive a genuine item to compare with the counterfeit.
Bernd Felsche
2018-11-29 11:25:55 +0000 UTCHow about we find out who they are a bomb them with "dont be so petty ( klein zieiig) requests!
Phil Maddox
2018-11-29 11:25:53 +0000 UTCFight them.
Michael Thompson
2018-11-29 11:09:48 +0000 UTCI really have no appropriate response for this post, other than "oh for fuck's sake, really?". Sorry you have to keep dealing with this silly rubbish Clive. Best of the season to you and yours from The Wonderful Land of Oz.
Chris Talbot
2018-11-29 10:41:33 +0000 UTCCan you ask the Dutch company to withdraw or reverse their complaint?
2018-11-29 09:57:41 +0000 UTCYouTube should be going out of its way to protect its educators. They make so much noise about being a platform for education.
2018-11-29 09:43:51 +0000 UTCIs this crap applied automatically without human intervention? If so Google's AI is a loong way from becoming skynet. If not the drones at Google need reeducation.
Wim
2018-11-29 09:18:07 +0000 UTCAll I can do is send Clive my best wishes.
Nuts 'n' Proud
2018-11-29 09:08:57 +0000 UTCSo much for 'free speech' (nazi tube)? Just have to snowpaque the logos out. So now you're obligated to contact them (logo co's) for anything you do? Which is their loss in the end. You're not know till you lift the hood. I tend to buy some of the tutt, you dissect too. Well they're certainly off the Crimbo list and they won't be getting a Crimbo card either!
2018-11-29 08:50:38 +0000 UTCWhat a bunch of shite!!! I mean they asked for you to take down the video and in a way you did make it inaccessible, but I bet that because you only made it private vs deleting the video in dispute and so then YouTube just followed through with the disputed claim automatic processing and then because of the claim being automatically processed even though you had already worked to resolve this issue and then the claimant forgot to release/remove the claim and YouTube doesn’t even seem to have any way to check if you have complied with the claims and thus your channel gets slapped with an unwarranted Strike and if you have enough Strikes then it RESTRICTS YOUR ACCESS TO YOUTUBE WHICH IS BULLSHIT!!!!
Zane Revai
2018-11-29 08:43:41 +0000 UTCIt would be neat if youtube fined companies for making false claims, or gave them a 'strike'. I should think that would work super well.
The Backoffice (Andrew Armstrong)
2018-11-29 08:43:10 +0000 UTCRaised my pledge, Don't let the man get you down.
2018-11-29 08:40:47 +0000 UTCThis is why I'm a patreon supporter and block ads on YouTube
2018-11-29 08:34:23 +0000 UTCBut quite unfortunate to hear. Is this your second or third strike?
Thomas Keppler
2018-11-29 08:21:59 +0000 UTCWell, it’s the time of giving, isn’t it :P?
Thomas Keppler
2018-11-29 08:20:51 +0000 UTCGutted for you - that's complete and utter bollocks. If there's any way you can appeal, please do. This might not even have been reviewed by a human knowing the way YouTube works..
Mike Broom
2018-11-29 08:18:45 +0000 UTCThat's a bit shite! Do you have the opportunity to challenge it further or not?
2018-11-29 08:12:19 +0000 UTCBut how can one be careful in light of such a weak pathetic claim? Literally any of the companies just vaguely featured in a video could try and pull this shite?
2018-11-29 07:50:16 +0000 UTCI'm wondering whether the problem was your "admitting you were wrong" by pulling the video at their request. I wonder what would have happened if you had brazened it out...
2018-11-29 07:49:43 +0000 UTCThat's crap. I have only done a few videos but I have been careful to black out company names before I start, corporate types get all squirmy as soon as their name gets mentioned outside paid advertising!
The Tinkering Shed
2018-11-29 07:47:31 +0000 UTCSo in essence, what we are all saying is YouTube are a bunch of plonkers
Neil Tonks
2018-11-29 07:13:48 +0000 UTCSorry about the strike but it's complete BS. On a positive note though, I really enjoy the content you provide as I'm sure a lot of others do. Thanks Clive.
2018-11-29 07:09:58 +0000 UTCI have a spare channel in my full name. But YouTube frowns on users having multiple channels. You guys are safe. If I get blocked on YouTube I'll post videos elsewhere and link them here.
Big Clive
2018-11-29 07:08:18 +0000 UTCSorry to hear Clive. Hopes be things look up this season nevertheless :)
Ryan G.
2018-11-29 07:07:42 +0000 UTCAHAHAHAHAHAHA you think youtube cares how anyone feels? Funny.
Ryan G.
2018-11-29 07:07:23 +0000 UTCIt means I have to tread with caution because another strike will block me from posting videos.
Big Clive
2018-11-29 07:06:19 +0000 UTCIt's been filed as a counterfeit claim - as if I've been promoting copied products for sale. I've got a feeling that the "sales director" of the company involved doesn't understand YouTube.
Big Clive
2018-11-29 07:04:24 +0000 UTCDefinitely challenge the strike. That falls well within fair use.
Jamie F
2018-11-29 07:04:00 +0000 UTCYes. I'm not sure what gets limited yet.
Big Clive
2018-11-29 07:02:46 +0000 UTCThat's really frustrating, especially as you were showing an actual 'thing', literally a copy with their logo. Normally on trademarks you have to specify all the forms you are registering it against, does this even apply to media in this way?! Grrr
The Backoffice (Andrew Armstrong)
2018-11-29 06:57:30 +0000 UTCThat's really poor! Can you put your videos on Vimeo instead or is there a restriction on having the same content in both places?
Ian Petrie
2018-11-29 06:56:21 +0000 UTCYouTube is great, but it’s also shit when stuff like this happens. Are you still able to post videos?
2018-11-29 06:48:03 +0000 UTCI may have missed something. What does it actually mean? Your not allowed to post anything? Your channel is no long there?? HELP!
Neil Tonks
2018-11-29 06:47:40 +0000 UTC^^ this
Dane
2018-11-29 06:43:39 +0000 UTCThat's a garbage strike and you should contest it. The company that sent the report is abusing the DMCA process, they have no right to request takedowns of videos simply containing an object bearing their logo.
2018-11-29 06:42:58 +0000 UTCBackup channel?
cvr
2018-11-29 06:42:37 +0000 UTCQuite honestly, YouTube is turning to shit these days. The good content just vanishes and that completely useless stuff makes the front page and gets shoved down your throat if you want it or not. It's time for a successor.
2018-11-29 06:42:29 +0000 UTCIm sorry to hear that. Thats terrible that YouTube are treating their creators like this. It's happening to so many creators.
Jamie Cruickshank
2018-11-29 06:42:24 +0000 UTCWhat The Fuck... that is just dumb. fucking copy right YouTube bullshit.

2018-11-29 06:42:22 +0000 UTCWell that’s a pain.
