The issue of "Zeke is not a tool" is black and white. He has to be handled as a human. And the question of is he responsible given the circumstances has to be handled on the trial.

I get your point, and you may be right, but there's a *morally* gray area.
If you flip this around and Zeke was a human with a bomb implanted in his head and told to kill people, otherwise his head would explode, is the issue so black and white?

@daniel Lim: it's easy. The driverless car is an algorithm. The decisions where made by the manufacturer. And more important for the "Is it a tool?"-Point Zeke wouldn't fail the touring test.
If he was forced to do would be a subject that the judge would have to deal with.
