Punching Up, Episode 19 | Palworld Vs Pokemon: Copying Nintendo’s Homework

In a very short amount of time, Palworld has exploded to become one of the biggest games of the year. Combining numerous elements of other successful games, it’s easy to see why it’s been appealing to so many. Despite the successes, there’s one area of the game that’s been called into question: the so-called 'Pals' themselves and their Pokémon counterparts. When does inspiration cross the line into theft, and has Palworld gone too far? Should Nintendo consider legal action against Palworld? Does Palworld introduce sufficient new elements to avoid copyright infringement? In this episode, we talk all about the craze, for better and for worse. Also, Nintendo is once again dominating in Japan and shows no sign of stopping, with a new console on the horizon. Please enjoy another episode of Punching Up!

Micah u should play ocarina of time if you ever try Zelda again

Metrogoonin

In terms of Palworld, the thing is you can not copyright art style or direction. Is it morally wrong? Maybe. Is it legally wrong, no.

Totally unasked for response from an ex-nuclear plant engineer. In the northeast, you can shop around for your power, unlike other regions where you pay the utility at a rate regulated by the government. This spawns an industry of poor bastards from real and fake companies, usually third party brokers, stuck going door to door (and calling, emailing, and snail mailing), trying to make you give enough of a shit about your energy bill to sign a contract to switch sources to “save money now!” and/or “switch to green energy!” They hope you’ll miss the fine print stating your rates will get jacked up a year or two down the line. You can save money this way if you pay attention and don’t get tricked by the fakers. Otherwise, don’t get scammed, don’t answer the door, and don’t take candy from strangers.

Jacob Rosnack

Hard disagree with Dagen on palworld not needing to rip off Pokémon’s art to be a success. The only reason anyone gives half a shit about palworld is because it has great value Pokémon in it.

WoodyBlock

Japan has no fair use laws and both companies are in Japan so it would make it a domestic lawsuit not international. The games been public for about 3 years. If they were going to sue they would have sued already.

I really enjoyed the Micha vs Felix the Cat story I can relate. Not scared of Felix but my whole life I have always been disturbed and slightly scared of E.T. lol

Danomind

Dagen has Link’s Awakening and LttP’s release order swapped. LttP came first (3rd Zelda release).

Xstar25

So much of that show and it's skits came flooding back when Dustin mentioned that. Pinky and the Brain, Buttons and Mindy and Good feathers!

Davario

There’s so much out there as far as Nintendo coming to Universal in bigger and better ways. Dustin, you should look into it! It’s not hard to find the very credible rumors going around, the patents, etc.

Good idea- having a surprise party for your dad. Bad idea- having a surprise party for your granddad… (has a heart attack and drops dead)

Glen Yelenovic

Nintendo is for sure going to sue Palworld and Xbox is going to have egg on their face for having to take it down. Very few people would have given 2 shots about the game if it didn’t straight up have Pokémon in it

Glen Yelenovic

Sushi is great in NYC, but rather pricey

I’m pretty sure Colin will burn in hellfire if he steps foot in the Nintendo store

Just seen Alana Pearce do a video on the palworld stuff, and she brought up how one twitter user who compared the model frames, actually admitted he lied and adjusted the scale. Why did he do this? Because he's upset how palworld glorifies animal fighting.

Angel DeJesus

Dagan “Takin’ It Slow” Moriarty lol

Colin Moriarty

Interesting discussion on Pal world, the point I really didn’t care for was the Grandma argument. If I showed my grandma my Xbox, she probably would call it a game boy. Ignorance to a product on the consumer end, should not, and does not make the developers actions illegal. Good discussion though, just thought I would throw in my two cents.

Austin Evans

I can’t wait to die on the Donkey Kong barrel ride.

Michael Mashpotato

The Freakazoid theme is goated

Michael Mashpotato

Agree!!!

MrFreundly

Micah, I echo Dustin’s recommendation of Ocarina as “Baby’s first Zelda” for you to get your feet wet! Anecdotally, my wife, who has similar gaming sensibilities to you (heavy on visual novels, hates puzzles, claims that many games aim to make her feel dumb lol), played the 3DS version to completion and had a blast. It’s also worth noting that it essentially was her first foray into any sort of 3D game environment, and she made it through just fine. If you ever find yourself ready to really take on Hyrule, I think OoT is a great choice!

Jordan

Let Dagan know he can get GamePass for PC he doesn’t need an Xbox console to check out Palworld on PC

Gray Gordon

Yo! The energy stuff isn’t a full scam, but basically. My wife fell for it as she got a letter in the mail with our energy provider stamped on the envelope. I don’t remember exactly, but there was something that made it seem like it’d be cleaner and cheaper.. but it was much more expensive in the end. Come to find out that it’s a third party that piggybacks off the local energy company somehow and it was a headache to get it fixed. We still get letters every month to come back.. and 10/10 don’t recommend.

Zachary Abell

Colin was right.

Zeke the Plumber

The Golden Sun game on the DS was awesome too.

Mateusz Kuklinski

Dagan mentions NYC and LA as 2 of the top sushi cities in the country. I would also suggest Seattle! Right on the Pudget Sound, the city is geographically set for lots of fresh seafood. The city is also home to many people who have immigrated from Asia (due to its somewhat close proximity across the Pacific), leading to a great range of cuisine 🙂

Vinny Pepperoni

Micah's first Zelda should be Link Between Worlds on 3DS

Craig Carter

I went to catholic school and instantly thought of this little ryhme my 5th grade teacher taught us when you mentioned st. Anthony "Tony Tony turn around, somethings lost and must be found." Never worked for me tho. Cool it worked for that dude and his switch game lol
