Actually, at this point we haven't established at all that Derek didn't kill his sister, just that the police let him go because they determined she was killed by an animal. Which could have totally been him, but the police obviously don't know about werewolves so they thought it couldn't have been him. But it's true that Scott is pretty oblivious to the possibility of there being more werewolves than just him and Derek.
