Not "were", they still are second years. In Japan school years start in April and end in March the following year. The student council presidential election happens after summer break (the start of the second term). I assume this is to give first years a chance to build up a reputation and have a serious chance to get elected.

Shirogane gets to look cool and romantic as if he guessed what Kaguya was thinking, sort of like when he found where she was hiding during the fireworks episode, but it also doesn't take away Kaguya's agency. Her finding the courage to speak up is still important and the whole reason that all of the stuff to follow will even happen.
