Touma's memory was erased by magic the first time with Index. It's just that the affect of the magic physically destroyed his brain cells that contained the memories. His imagine breaker can negate magic but any physical damage stays. So if his left arm is being burned by magical fire, he can remove it but his arm is still burned. Also Index has no protection from her clothes no matter if she has the hat or not.

Touma destroyed it and its totally broken now so nothing is protecting Index all she did was pin it back together but it doesnt work at all now. so she can be severely injured now. and the plot just gets jucier and jucier in the following episodes

In fact, when British news say a perp is "Asian", they mean MIDDLE-EASTERN/Arab, since Oriental is the designation for racial groupings we would call "Asian", due to history related reasons. Thus it's perfectly reasonable for a Bri'ish person like ya boi to use it Also the memory erasure WAS magic. Imagine Breaker is useless against certain anti-alignment type magics
