I'm pretty sure the Emperor doesn't want Miyo to be discovered for the very reason why you said the two families should intermarry. the Usuba's purpose for existing is as a counter to other special ability users, since if they turned against the empire that could be bad for the current regime. If a baby was born from the strongest Usuba and the strongest Kudou that had both abilities it would upset the power balance. So the Usuba's not intermarrying with other families to make an OP baby is probably the condition that allows them to exist as far as the Empire is concerned. Also I don't think they did a good job explaining but I think the reason they didn't go get Miyo before her abilities awakened is because it would have been illegal since they technically had no rights to custody and Miyo's birth Family even if they abused her never did anything illegal that could be proven. (Until they kidnapped her at the end of arc 1 which I still think was dumb writing for a stupid fight to satisfying the audience revenge boner.) Now that she HAS abilities they probably have the backing of the empire to sweep any legal troubles under the rug, plus since Kudou lost Miyo in an agreed upon dual they have a case. So perhaps they COULDN'T get Miyo without the empire coming down on them until she showed abilities and thus had an excuse to do so without said emperor getting onto them. Because otherwise they'd be breaking the law taking Miyo away from first her abusive family and then her fiance.
