Jiraiya didn't break the fox seal, He broke the barrier which Orochimaru put on Naruto after their fight so he can't use the nine tails chakra.

Orochimaru's seal was preventing Naruto from using the Nine Tails chakra and making it difficult for him to use his own ("blue" chakra). Orochimaru applied this seal in the forest during the 2nd exam
