NSFW Commission — Kickstarter

PLEASE NOTE: Do not use character names / company names in the comments.

As you may already know, I discourage the members of the Legion of Arch Nemeses from choosing licensed characters for their commissions. This commission was from the Kickstarter campaign for Evil Inc After Dark Vol. 2. Since those requests fell under a one-time-only category, I relaxed my own rules on the issue.

However, to mitigate any potential issues, I need to enforce a strict policy against using character names or company names in the comments.

You have to be very careful. There have been some very notorious porn parody comics written by someone calling themselves "Tracy Scops," and the artists on them are pretty prominent in the fan community, but they all use multiple pseudonyms to avoid the wrath of the lawyers.

That's an interesting take on Phenomenal Lass and Giggler, with the costume variations.

We could go back and forth for hours, but the answer is simple. The side with the bigger lawyers wins the argument. I will never win an argument with AT&T (which owns DC Comics). So I tend to avoid arguments with them, whenever possible. :)

So... here's the full story... and more information than you ever wanted. I follow a large number of NSFW comics artists on Patreon, and one of them consistently advises their Patreon backers not to use "character names or company names" in the comments. Now... I know from years of experience that NSFW artists (a) tend to have a tenuous grasp of copyright/trademark issues, and (b) tend to massively exaggerate any content regulation that companies like Patreon enact. However... against my better judgement, this one got under my skin. So... I messaged the NSFW creator and asked them *why* they kept posting the "no names" reminder. That's when I was reminded of the *third* thing I've learned about NSFW creators... they can be VERY secretive. It's not like the webcomics community I cut my teeth in, where we shared *everything* we learned as we were learning it. I still haven't gotten a response, and I don't expect to. And that's perfectly fair. That person owes me nothing, and I'm OK with that. Reading in between the lines of the "No names" request, my guess is that Patreon may have written a 'bot that skims comments to locate such posts so they can weigh in on any that cause a legal risk to the platform. That’s why I posted the “no names” request. If/when I’m able to get better information on the subject, that request may change. Until then, I’m playing it safe.
