Well malcolm was in hell for 30 years, assuming he is older than 30 years (i'd say he was mid 30s maybe early 40s) he still technically spent more time on earth than in hell (his soul that is). i doubt that is enough to get a stench of hell on you. Compared to tens of thousands of years that Charlotes soul was tortured in hell its understandable why she stinks of it and malcolm doesnt.

He might even be charged with accessory after the fact because he tried to cover it up with his silence and steering her away from revealing her handwriting. Regardless, he won't have nearly the prison sentence she will have, presuming one or both is convicted, and they would most certainly be housed in separate facilities. If not, there are separate blocks for men and women the correctional facilities, and they would still be kept apart.

Even if it was full minute, that means 1h=180 years. one day is 4320 years. so considering she was in hell for whole season 2, her soul was tortured in hell for tens of thousands of years. Its incomparable to 30 years malcolm was in hell.
